Wanneer is een MP3 legaal
Muziek in MP3-formaat is gewoon auteursrechtelijk beschermd. Zonder toestemming verspreiden van MP3's
Mag dus niet. Downloaden is legaal. Linken en zoekmachines zijn dat vaak ook.
Eén van de meest gedownloade soort bestanden is de MP3. Vrijwel elk liedje, hoe obscuur ook, is wel ergens op Internet te vinden. Ook de recentste hits uit de top 40 zijn zonder problemen te downloaden van websites.
En mocht een bepaald liedje toch niet te vinden zijn op het Web, dan zijn er altijd nog de file sharing netwerken zoals KaZaa. Kortom, elk muziekwerk is gratis te verkrijgen voor iedereen met een redelijk snelle Internet-verbinding.
Een vervelend detail daarbij is dat muziek auteursrechtelijk beschermd is. Dit betekent dat de maker van het werk toestemming moet verlenen voordat deze muziek op Internet verspreid mag worden.
In de overgrote meerderheid van de gevallen is dit niet gebeurd, want de meeste muzikanten hopen geld te verdienen met het uitbrengen van cd's met hun muziek daarop.
De muziekindustrie klaagt dan ook steen en been over de inkomsten die zij meent te missen door al die gratis downloads. Naar Nederlands recht is downloaden van MP3 echter legaal,
mits er sprake is van een thuiskopie.
